1. Terms and Conditions

1.1. These Terms and Conditions regulate the access and use of the Ayia Napa Winter Swimmers (hereinafter referred to as “ANWS”) website www.ayianapawinterswimmers.cy, which govern your access to and usage of the said website. By accessing the website, you are hereby agreeing to comply with these Terms and Conditions.

2. Services in regards to participating in the third edition of the festival, in January 2026

• 2.1 Events with complementary or free participation ticket/s
• 2.2 Events with paid ticket/s

3. Payment

• 3.1 Payments using any of the Services may be made by using only Visa or MasterCard credit cards.
• 3.2 We are not directly involved in the online payment but through a third-party service provider, who is a PCI DSS-compliant payment processor.
• 3.3 All payments are to be made in Euro (EUR) and any additional fees that may be imposed will be paid by the visitor.
• 3.4 Upon completing a transaction using the Service, you will be presented with a confirmation screen verifying the transaction details you wish to process. It is your responsibility to verify that all transaction information and other details are correct.
• 3.5 We have no liability for transactions, which are incorrect as a result of inaccurate data entry in the course of the use of the Service or for loss of data or information caused by factors beyond our control.
• 3.6 You will receive a confirmation email / receipt with a QR code once the payment has been received and approved.

4. Fees

• 4.1 International cardholders making any payments may incur their own bank’s international service fees.
• 4.2 We may refund your payment or part of your payment in accordance with clause 5 only.

5. Refund Requirements

• 5.1 Requests for refunds (i.e. in case of cancellation of your trip to Cyprus, or other) must be made in writing and not AFTER 15 December 2025. Any Refund Requests must be sent to [email protected].
• 5.2 Refunds are approved by us and they will only be made to the debit/credit card used for the original transaction.

6. Warranties and Disclaimers

You warrant to us that:

• 6.1.1 You are aged 18 or over, with full legal capacity to enter into this legally binding agreement under the applicable law.
• 6.1.2 You will pay the credit issuer all charges that may incur in relation to the payment(s).
• 6.1.3 The information supplied by you is true and correct.

6.2 To the extent permitted by law, we do not accept liability for any damage, loss, costs (including legal costs), expenses, indirect losses or consequential damage of any kind which may be suffered or incurred by you from the use of the Services or this website.

6.3 ANWS reserves the right to unilaterally modify the Terms and Conditions of this website at any time and without notice. ANWS will post online the current version of the terms of use, while the continued use of the website or its services will be considered as an acceptance of the new terms. For this reason, each user is kindly requested to check the terms of use at regular times.

7. Privacy and Use of Information

• 7.1 We collect and process your personal information in accordance with the GDPR and the Cyprus Data Protection Law (Law 125(I)/2018).
• 7.2 Personal information will be used solely for the purposes for which it is supplied, including verifying payment details and processing payments.
• 7.3 No credit card information is stored by us directly.
• 7.4 All payments are processed via a secure third-party gateway. We implement technical and organisational measures to protect your data but are not liable for third-party breaches.
• 7.5 Your data will be retained only as long as necessary. You may request deletion subject to legal requirements.
• 7.6 In accordance with GDPR, you have the right to:
  • Access your personal data
  • Request correction or deletion
  • Object to or restrict processing
  • Withdraw your consent (where applicable)
  • Lodge a complaint with the Office of the Commissioner for Personal Data Protection in Cyprus

8. Governing Law

8.1 These Terms and Conditions are governed by the Cyprus Law. The Cyprus Courts have exclusive jurisdiction in relation to legal proceeding arising out of or in connection with these Terms and Conditions.
